Noah Cherry Obtains Probationary Sentence in PPP Loan Fraud Case in the Eastern District of Virginia

On May 24, 2024, Schertler Onorato Mead & Sears associate Noah Cherry obtained a sentence of three years’ probation with six months of home confinement for a client in the United States District Court for the Eastern District of Virginia. Earlier this year, the client entered a pre-indictment guilty plea to one count of wire fraud for misusing $455,000 in Paycheck Protection Program (PPP) loan and Emergency Injury Disaster Loan (EIDL) proceeds on a variety of personal and ineligible uses, including gambling, paying down personal debts, and purchasing two properties in Northern Virginia. At sentencing, Mr. Cherry successfully advocated for a downward variance from the advisory Sentencing Guidelines range.
