Schertler Onorato Mead & Sears partner David Schertler and associate Noah Cherry secured a dismissal of all charges against their client in the United States District Court for the Western District of Texas. The dismissal occurred as part of a plea agreement between the government and the client’s co-defendant/husband. SOMS’s client originally was indicted in 2022 on charges of wire fraud, false statements, conspiracy, and evading taxes. Her husband was charged, in addition, with illegally exporting defense articles. The district court ultimately dismissed the fraud counts for failure to state a claim. The co-defendant subsequently agreed to plead guilty to two tax counts in exchange for dismissal of all remaining charges, including those against his wife. On October 2, 2024, the co-defendant was sentenced to five years of probation with two years of home confinement, and the government dismissed the remaining charges, including those pending against SOMS’s client.
